1. Acceptance of Terms

By accessing or using OpenPrompts (openprompts.in), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Description of Service

OpenPrompts is a free, community-driven directory of AI prompts. Users can browse, search, copy, bookmark, and submit prompts for various AI models including ChatGPT, Claude, Midjourney, and others.

3. User Accounts

  • You may browse prompts without creating an account.
  • To submit prompts, bookmark, or upvote, you must authenticate via Google OAuth.
  • You are responsible for maintaining the security of your account.
  • You must not create accounts for the purpose of spamming or abusing the platform.

4. User-Submitted Content

4.1 Ownership and License

When you submit a prompt to OpenPrompts, you retain ownership of your content. However, by submitting, you grant OpenPrompts a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your submitted content on the platform and for promotional purposes.

4.2 Content Guidelines

By submitting a prompt, you represent and warrant that:

  • You are the original creator of the prompt, or you have the right to share it.
  • The prompt does not infringe upon any third party's intellectual property rights, copyrights, trademarks, or other proprietary rights.
  • The prompt does not contain illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.
  • The prompt does not contain malicious instructions designed to cause harm, generate dangerous content, or bypass AI safety measures.
  • The prompt does not contain personal information of any individual without their explicit consent.
  • The prompt is not primarily designed for fraudulent, deceptive, or unethical purposes (e.g., phishing, scamming, impersonation).

4.3 Content Moderation

OpenPrompts reserves the right to review, edit, or remove any submitted content at our sole discretion, without prior notice. We are not obligated to monitor all user submissions but may do so to ensure compliance with these Terms.

5. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit content that violates these Terms or applicable laws
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated tools (bots, scrapers) to extract content from the platform at scale without permission
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate another person or entity

6. Intellectual Property

The OpenPrompts platform, including its design, logo, code, and original content, is the property of OpenPrompts. User-submitted prompts remain the intellectual property of their respective creators, subject to the license granted in Section 4.1.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Any prompt will produce the desired results with any AI model
  • User-submitted content is accurate, complete, or reliable

8. Limitation of Liability

To the fullest extent permitted by law, OpenPrompts and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or profits.

9. Indemnification

You agree to indemnify and hold harmless OpenPrompts from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Changes to These Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
